Really? Any court of law would laugh this out of the courtroom.


The NCAA is claiming that Todd McNair was aware of a supposed agreement between Reggie Bush and New Era sports based on 4 phone calls, one picture, and McNair's attendance at Marshall Faulk's birthday party.

The NCAA conceded that there were many conflicting accounts as to whether or not Todd McNair hung out with Lloyd Lake or Michael Michaels at a large birthday party gathering in downtown San Diego for Marshall Faulk on March 23, 2005. The NCAA could not substantiate the claim that McNair spoke to or even saw Lake or Michaels on this night.

After a home game vs. Washington State on October 29, 2005, McNair is photographed in the locker room with actor comedian Faizon Love and Lloyd Lake. It is important to note that USC was not provided with an original photo and that the picture the NCAA provided was clearly cropped and that a female hand can be seen on McNair's shoulder although a female doesn't appear in the picture. McNair claims that he doesn't remember the photo and didn't recongnize Lake or Michaels. It is plausible that a USC football coach would take numerous pictures with unknown people.

On the same night as the picture (10/29/2005) Reggie Bush was the official host for LeSean McCoy. McNair was responsible for McCoy's recruitment. Bush was supposed to pick up McCoy at midnight to take him out to a club. McNair placed 3 one minute (or less) phone calls to Lloyd Lake's cell phone between 11:39 and 11:56 pm. He told the investigators that the number was likely provided by Reggie Bush as an alternate number to contact him. McNair was calling a number Reggie provided to make sure he was picking up McCoy. In any case, the calls were all one minute or less and the records do not tell whether or not McNair spoke to anyone or simply went to voice mail. The NCAA is trying to connect the dots to prove these calls established a relationship with McNair and Lake. That's a big assumption on 3 one-minute calls that likely went to voice mail.

On January 8, 2006, Lloyd Lake called McNair and the conversation lasted 2 minutes and 32 seconds. Bush had yet to declare for the NFL but was analyzing his options and clearly was expected to leave USC. Lake claims he told McNair that Bush better sign with New Era because he wasn't getting screwed out of his money. McNair called Bush several hours later. When Bush returned his call, they spoke for 13 minutes. The NCAA is surmising that in 2 minutes and 32 seconds, McNair was told of the financial arrangements of New Era and Bush and that his 13 minute conversation many hours later confirms his guilt. WHAT A REACH considering Bush was making his final decision about declaring for the NFL and it would make sense for the two to talk.
